Quick read: By using Nirvaan you agree to these terms. You must be 18+, your account is your responsibility, and prices and stock can change. Payments are RBI-compliant. Indian law applies. The detail is below.

Acceptance of terms

These Terms & Conditions ("Terms") govern your access to and use of the Nirvaan mobile app and the nirvaan.in website (together, the "Platform"), operated by Nirvaan ("we", "our", "us"). By creating an account, placing an order, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree, please do not use the Platform.

Eligibility & accounts

  • You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872 to use the Platform.
  • You are responsible for the accuracy of the information you provide and for keeping it up to date.
  • You are responsible for all activity under your account, and for keeping your login credentials confidential. Notify us at connect@nirvaanapp.in immediately if you suspect unauthorised access.
  • One account per person. Retailer accounts are also issued per business entity — see section 07.
  • We may refuse, suspend, or close accounts at our discretion if these Terms are violated.

Use of the Platform

You may use the Platform only for lawful, personal, or business purposes consistent with these Terms. You agree to follow all applicable laws and not to:

  • Use the Platform in a way that interferes with other users.
  • Misrepresent your identity, your business, or the items being ordered.
  • Attempt to bypass pricing tiers, bulk-discount eligibility, or any other access control.
  • Use the Platform to resell products in violation of the retailer-specific terms (section 07).

Orders, pricing & payment

Listings

Product listings on the Platform (including specifications, images, and stock indicators) are provided by us or by our supply partners. We work to keep them accurate but cannot guarantee that every listing is free of error. If we discover a material error after you have placed an order, we will contact you to confirm or cancel the order before dispatch.

Pricing

  • All prices on the Platform are in Indian Rupees (₹) and, unless stated otherwise, are inclusive of applicable GST.
  • Wholesale/bulk pricing is shown only to verified retailer accounts. Sharing wholesale prices outside your account is a breach of these Terms (see section 07).
  • Prices and offers may change at any time. The price applicable to your order is the one shown at the time you place it.

Payment

  • Payments are processed by RBI-compliant payment gateway partners. We do not store your full card number, CVV, UPI PIN, or net-banking credentials. See our Privacy Policy for who we share what with.
  • An order is confirmed only when payment is successfully captured (or, for COD where offered, when the order is acknowledged in-app).
  • If a payment is reversed, charged back, or otherwise fails after dispatch, we may suspend or cancel the order and pursue recovery.

Delivery

  • We deliver across India through our logistics partners. Delivery timelines shown on the Platform are estimates only and depend on pin code, item availability, and circumstances outside our reasonable control.
  • Risk of loss passes to you on delivery to the address you provided.
  • If the courier records a failed delivery attempt and the order is returned to origin, we may charge a return-to-origin fee or cancel the order.
  • Please inspect packages on receipt and report visible damage within 48 hours via the in-app help flow.

Cancellations, returns & refunds

Specific product-level return windows and conditions are shown on each listing inside the app. As a baseline:

  • Order cancellation — available before dispatch. Once dispatched, an order can be refused at delivery or returned per the rules below.
  • Returns for damaged / defective / wrong items — eligible for a free pickup and full refund or replacement if reported within the window shown on the product listing (typically 7 days from delivery).
  • Returns for change of mind — only available where explicitly mentioned on the product listing, and subject to the item being unused, in original packaging, and within the listed window.
  • Refund timelines — once we approve a return, refunds are initiated to the original payment method and typically credit within 5–7 working days, depending on your bank.
  • Non-returnable items include items damaged due to misuse, items with broken seals where prohibited, and any item explicitly marked non-returnable on its listing.

Retailer-specific terms

If you've registered for a retailer account, the following additional terms apply:

  • You confirm you are a legitimate business entity registered in India and that the GSTIN, PAN, and KYC documents you provide are true and current.
  • Wholesale pricing, tiered discounts, and bulk-only items are made available to you for your business use only. You agree not to share screenshots, exports, or details of wholesale pricing with anyone outside your business.
  • You will use a real shipping address (business or warehouse) — not a personal residence used for personal consumption.
  • Bulk-discount eligibility requires meeting the minimum-order conditions shown for each tier. We may verify that purchased items are for resale or business use.
  • We may suspend retailer privileges if we reasonably suspect misuse — including fraudulent KYC, splitting orders to avoid threshold checks, or onward sale that breaches manufacturer territory rules.

Intellectual property

The Platform — including the Nirvaan name, the house-and-plug logo, the app interface, the photography, copywriting, and the underlying code — is owned by Nirvaan and protected by Indian and international IP laws. You may not copy, reproduce, modify, reverse engineer, scrape, or create derivative works without our prior written consent.

Product photography on listings may be provided by manufacturers or supply partners and is used under licence.

User-generated content

If you post a review, rating, photo, or comment on the Platform, you confirm that:

  • The content is yours to share, and you grant Nirvaan a perpetual, worldwide, royalty-free licence to host, display, and use it on the Platform.
  • The content is honest, not paid-for, and reflects your genuine experience with the product.
  • The content does not contain personal data of other people, hate speech, defamation, sexual content, or anything else unlawful.

We may moderate, edit, or remove user content at our discretion.

Prohibited activities

You agree not to:

  • Use the Platform to commit fraud, money laundering, or any other crime.
  • Probe, scan, or test the Platform's vulnerabilities except via our responsible-disclosure email (connect@nirvaanapp.in).
  • Use bots, scrapers, or automated tools to collect data from the Platform without our written permission.
  • Upload malware, viruses, or any code designed to disrupt service.
  • Misuse promotional codes, referral programmes, or pricing tiers.
  • Use the Platform on behalf of someone else without their permission.

Disclaimers & limitation of liability

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties — express or implied — including fitness for a particular purpose, accuracy of listings, and uninterrupted availability.

To the maximum extent permitted by law, Nirvaan's total aggregate liability arising out of or related to the Platform, in any 12-month period, is limited to the total amount you paid to us in that period, or ₹10,000 — whichever is higher. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of data, or business interruption.

Nothing in these Terms excludes liability that cannot be excluded under Indian law (e.g., for death or personal injury caused by gross negligence).

Indemnity

You agree to indemnify and hold Nirvaan, its officers, employees, and partners harmless from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your misuse of the Platform; (c) your violation of any law or third-party right; or (d) any content you upload.

Termination

You may close your account at any time via in-app Settings → Account → Delete account. We may suspend or terminate your account if you breach these Terms, misuse the Platform, or if we are required to do so by law. On termination, sections that by their nature should survive (e.g., IP, liability, indemnity, governing law) will continue to apply.

Governing law & disputes

These Terms are governed by the laws of India, without reference to its conflict-of-laws principles. The courts located in [city of jurisdiction — to be added] will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Platform, subject to the right to pursue small-claims remedies in a consumer's local district forum where the law allows.

Before formal proceedings, we encourage you to contact us at connect@nirvaanapp.in so we can try to resolve the matter directly.

Changes to these terms

We may update these Terms from time to time. Material changes will be notified in-app and (where we have your email) by email, at least 14 days before they take effect. Continued use of the Platform after that date means you accept the updated Terms.
